Inheritance: Simple Steps

Inheritance refers to the property, rights, and obligations of a deceased person (the testator) that are transferred to other individuals (the heirs).

Inheritance: What You Need to Know About the Procedure and Heirs’ Rights

Accepting an inheritance is a strictly regulated legal process with specific rules and deadlines. The general period for accepting an inheritance is six months from the date of the testator’s death or from the date a court decision declaring the person deceased comes into effect.

Inheritance law is governed by the Civil Code of the Russian Federation.

There are three grounds for inheritance: by law, by will, and by inheritance contract.
Inheritance by law generally applies when there is no will or inheritance contract. A will or inheritance contract expresses the testator’s wishes regarding the distribution of their property.

Steps to Formalize Inheritance:

  1. Confirm your right to inherit.
  2. Prepare the necessary documents:
    • Death certificate of the testator
    • Certificate of the testator’s last place of residence
    • Documents proving ownership of the testator’s property
    • Will (if any)
    • Documents proving kinship between the heir and the testator
    • Passport of the heir
  3. Submit these documents to a notary at the testator’s last place of residence.
  4. Pay the state fee, which depends on the degree of kinship and the value of the inheritance.
  5. Obtain a certificate of inheritance from the notary after the six-month period and document verification.
  6. Register your ownership rights.
